Decree on the application of special economic measures in the fuel and energy sector in connection with the establishment by some foreign states of the marginal price of Russian oil and petroleum products
The Head of State signed a decree “On the application of special economic measures in the fuel and energy sector in connection with the establishment by some foreign countries of the maximum price for Russian oil and petroleum products.”
Text of the Decree:
In connection with the unfriendly and contrary to international law actions of the United States of America and foreign States and international organizations that have joined them, aimed at setting the maximum price for Russian oil and petroleum products, in order to protect the national interests of the Russian Federation and in accordance with Federal Laws No. 281-FZ of December 30, 2006 “On Special Economic Measures and compulsory measures”, dated December 28, 2010 No. 390-FZ “On Security” and dated June 4, 2018. No. 127-FZ “On measures of influence (counteraction) to unfriendly actions of the United States of America and other foreign States” I decree:
- To establish that in connection with the introduction by the United States of America and the foreign states that have joined them of a ban on the sea transportation of Russian oil and petroleum products, the provision of services related to such transportation, which is applied in the case of the sale of Russian oil and petroleum products at prices above the marginal price set by the specified foreign states (the mechanism of fixing the marginal price), is prohibited supplies of Russian oil and petroleum products to foreign legal entities and individuals provided, that the contracts for these supplies directly or indirectly provide for the use of a mechanism for fixing the marginal price. The established prohibition is applied at all stages of deliveries to the final buyer.
- The ban on the supply of Russian oil established by this Decree shall apply from the date of entry into force of this Decree.
- The ban on the supply of Russian petroleum products established by this Decree shall apply from the date determined by the Government of the Russian Federation, but not earlier than from the date of entry into force of this Decree.
- Deliveries of Russian oil and petroleum products, the implementation of which is prohibited in accordance with this Decree, may be carried out on the basis of a special decision of the President of the Russian Federation.
- To the Government of the Russian Federation:
a) determine the list of codes of goods according to the unified Commodity nomenclature of foreign economic activity of the Eurasian Economic Union, in respect of which the provisions of this Decree apply;
b) determine the date from which the ban on the supply of Russian petroleum products established by this Decree applies;
c) adopt acts aimed at implementing the prohibition established by this Decree;
d) determine the procedure for monitoring the implementation of paragraph 1 of this Decree. - The Ministry of Energy of the Russian Federation shall monitor the implementation of paragraph 1 of this Decree on a regular basis in accordance with the procedure determined by the Government of the Russian Federation.
- Grant the Ministry of Energy of the Russian Federation the right to give, in coordination with the Ministry of Finance of the Russian Federation, official explanations on the application of this Decree.
- Assign to the interdepartmental working group on issues related to activities in the fuel and energy sector control over the implementation of this Decree.
- This Decree comes into force on February 1, 2023 and is valid until July 1, 2023.
